Nethergate Brewery Ltd statement of trading terms and conditions, and customer protection policy.

1. General Terms and Conditions of Trade.

The Nethergate Brewery, part of Nethergate Holdings, also trading as Partybeers.com,  offers buyers quality real ales brewed in their Pentlow brewery. The ales are guaranteed to be of the type named on the container in which they are sold, and on leaving the Brewery will be in best condition, fit for immediate consumption. They are guaranteed to meet the ABV % shown on the order form and on the container. 
Prices are as shown in the price-list and on the website, and apply from the date shown on the list. All prices include VAT at 17.5%, or as will apply at the time of ordering if the VAT rate is amended. Prices also include delivery, with some exceptions, as shown.
Delivery will be made by carrier or the company's own transport, and will be sent to the address shown on the customer's order. A signature confirming receipt will be required for proof of delivery.  If parcels cannot be left at the addressees' premises for some reason, the parcel will be taken to the closest post office or carrier's depot, and the customer advised where it may be collected.
Damaged goods will be replaced if notified to the company within 24 hours of arrival. If replacement stock is no longer available and no alternative is acceptable, their value will be refunded in full.
Goods lost in transit will either be replaced, or if replacement stock is no longer available, their value will be refunded in full.
The availability of orders will be confirmed at the time the order is placed.
Orders are fulfilled in order of receipt, although any special timing requests are accepted where practical. 
No substitutions are made without the permission of the purchaser.
All orders are acknowledged, and are given an order number to facilitate progress calls.
Where there are queries on the input to the order it is normal practice for a member of the management to telephone, fax, email, or contact by letter the customer to obtain the necessary clarification.
In accepting a customer's order, and allocating it an order number, the Nethergate Brewery Ltd enters into a contract with the customer to supply the goods in the quantities and at the prices indicated on the order form. Should the supply situation dictate that the order cannot be met, either in part or in full, the customer will firstly be advised, with the offer of a substitution, or will be refunded for the full value of the stock that cannot be supplied.
The customer can  amend or cancel an order up to two days before it is to be dispatched, without penalty.
If the goods are found to be faulty on arrival the customer should notify the company within 48 hours. The Company will advise on the action required to validate the claim. This will probably entail returning the goods to the Brewery, which if the fault is the responsibility of the Company, will be at the Company's expense.
Orders may be cancelled up to seven days after their receipt. The goods must be returned to the brewery at the expense of the buyer. If received in the same condition as the goods left the brewery a full refund, excluding carriage, will be made.
The payment for the order, whether by cheque or credit-card, is not processed until the order is ready for delivery.
All customers of the Nethergate Brewery are protected by all applicable UK laws.
 

2.  Privacy statement and data protection statement

No information regarding customers is passed to other organisations, or to individuals. All data is destroyed once it has no further use. Credit card receipts are shredded once the transaction is cleared, and no record of credit card numbers is retained. All computer information is stored on "stand alone" discs, inaccessible save by the company's directors.
